a）该等资料接收人在收到收据之前就已经知道的

比如

(i)该类信息实际上是在收件人的记录文件里；

(ii)有关的资料并没有直接或间接的被Flowsrve 熟悉

；或

b）这些资料是因为没有限制而从第三方合法取得的，没有违反本协议的第三方；或

c）该信息是目前，或者其后渐渐使大众可得，不需要通过任何行动或者是由于接收者的错误行动造成的
