第二条、租赁客体

Article2. Object of the Lease 2.1 出租人出租其位于xxxx 的公寓。包括所有的附属装置、家具和电器 (以下统称租赁房产)

The Landlord leases out the apartment located at xxxxx Including all fixtures, furniture and appliances (hereafter referred to as the leased property).

2.2 该租赁房产的总面积为xxx平方米。其中:卧室x 间,卫生间x,厨房x间,洗衣房 间,地下室 ,车库 ;

花园面积 平方米,(包括草坪、花草、树木、围栏等)

Area of the leased property is xm2 ,in which there are bedroom x washing room x, kitchen x laundry , basement , garage , garden m2 with all appurtenances.

2.3 承租人有权使用出租人供所有承租人使用的共用面积。

The Tenant shall he the right to use the mon areas shared by all tenants.

2.4 该租赁房产仅用于承租方指定人员居住,不得用于经营等其它用途。

The Tenant shall use the leased property only for residential purpose.

2.5 本合同附件一为房产证明或购房合同及业主身份证复印件(营业执照复印件)。

本合同附件二为家具、附属装置和电器的清单。

Copy of ownership Certificate of Leased Property or purchased contract of leased Property and copy of the landlords identity certificates (business license) is attached as Appendix I to this Contract.

The list of the furniture, fixtures and appliances in the leased property is attached as Appendix II to this Contract.)

第三条、租期

Article3. Lease Term 3.1 租期为1年,自x xxx 起,至xxxxx日止。

The lease term is for xx year, mencing on xxx,expiring on xxxxx

3.2 合同期满后本合同终止,承租人若想延长租期,应在租期届满前的至少1个月书面通知出租人。

Should the Tenant want to extend the lease term, he shall notify the Landlord in writing not later than 1 month before the expiration of the lease term.

第四条、租金与支付条款

Article4. Rent and Terms of Payment

4.1 租金应为未税每月xxxx RMB,租金每半年支付一次。

每月房租包括:发票税金xxx,物业管理费xxx元,有限(数字)电视的安装和使用费xxx元,宽带安装和使用费xx元,中介费用xx元,车位费xxx元,水电气费xxxx元,一年内超出限额部分的水、电、煤气费用由承租方支付。

The rent shall be xxRMB without tax per month. The rent shall be paid six month. The monthly rent should include official tax RMBxxx ,the Management Fee RMB xx, the TV installation fee and using fee RMB xxx, the broadband installation fee and using fee RMBxx, agency fee RMB 0, and utility fee such as: water, electrical and gas fee RMB xxx which will be balanced by year. The extra utility fee over the above mentioned limitation should be paid by the tenant.

Payment shall be effected through bank transfer.

第五条、管理服务与管理费

Article5. Management Services and Management Fee

出租人应对该租赁房产进行维护。管理费用包括,但不限于,建筑物内外的公共用地的清扫、对指定的垃圾箱内垃圾的清除,该地区电线和管道设施维护的费用。

The Landlord shall conduct maintenance on the leased property. The management fee includes, but is not restricted to, the cleaning of mon areas, garbage removal from designated dustbins, maintenance of electric wiring and plumbing facilities on the area.

第六条、税费

Article6. Taxes and Fees

出租人应支付政府部门向其征收的除租房税金外的所有税费。

The Landlord shall pay all taxes and fees levied on him by the authorities except the rent tax.

第七条、租赁房产的状况

Article7. Status of Leased Property 7.1 出租人应不迟于租期的第1(大写:壹 )天将该租赁房产以清洁、良好的状态移交给承租人,并在移交的同时交

出该租赁房产的钥匙。

The Landlord shall deliver the leased property to the Tenant in a clean and good condition no later than on the 1st (in words: first) day of the lease term. The Landlord shall hand over keys of the leased property at the time of delivery.

7.2 出租人在任何时间都应使该租赁房产保持良好的状态。出租人应对房产的结构及各项设施和设备 进行维护,

并在出现问题的情况下及时纠正或维护;如果出租人没有在合理时间内但不迟于接到通知后的一个星期内纠正该问题,则承租人有权请求赔偿和/或纠正该瑕疵,费用由出租人承担,承租人应向出租人提供所付费用的资料和收据。30天内未能解决,承租人有权立即搬出此房,并不承担任何赔偿。

The Landlord shall at all times keep the leased property in good condition. The Landlord shall provide maintenance to the property and repair defects such as: cracks on the wall in a structure; electric appliance works unproperly; construction against the local or pound regulation. If the Landlord fails to correct defects within due time but not later than 1 week after being notified, the Tenant shall he the right to claim damages and or correct the defects at the expense of the Landlord. The Tenant shall provide the Landlord with documentation and receipts of costs incurred. There shall be no penalty provided it cannot be solved in 30 days, and The Tenant has the right to check out.

7.3 在非因承租人过错租赁房产出现问题的情况下,比如,但不限于空调故障,出租人应在收到承租人的通知后毫

不迟延地进行维修或纠正。 如果出租人未能及时解决问题,则承租人有权自行或聘请第三方进行维修,维修产生的费用由出租人承担,承租人应向出租人提供所付费用的资料和收据。同时,出租人应向承租人赔偿维修费用以外的其他损失(若有)。

In case of any problem of the Premises not arising from the Tenants fault, including but not limited to a

defective air conditioner, the Landlord shall carry out remedy or repair without delay upon receiving a notice from the Tenant. If the Landlord fails to resolve such problems within due time (not later than 1 week after being notified), the Tenant shall he the right to he it repair by itself or any third party at the expense of the Landlord. The Tenant shall provide the Landlord with documentation and receipts of costs incurred.

Meanwhile, the Landlord shall indemnify from the Tenant any other loss in addition to the repair fees, if any.

第八条、使用规则

Article8. Rules of Occupancy

承租人应遵守下列使用规则:

The Tenant shall follow the rules of occupancy as follows: 8.1 承租人只应将该租赁房产作为其住处。

The Tenant shall use the leased property only for residential purpose.

8.2 承租人有义务杜绝在租赁房产内从事任何会对其他承租人或出租人造成不合理干扰的活动。

The Tenant shall not allow anything to be done on the leased property that would unreasonably disturb other tenants or the Landlord.

8.3在租赁期间,承租人应有义务使该租赁房产保持干净和良好的条件。正常的损耗应指在承租人及其家人的正常和合理使用期间产生的损耗。

The Tenant shall he the duty to keep the leased property clean and in a good condition for the duration of the lease term. Fair wear and tear shall mean such wear in the house is exposed to during the normal and reasonable use by a Tenant and Tenants family.

8.4 承租人如果发现租赁房产中的供电、煤气或供水设施、电线或管道已证明有危险或可能证明有危险,应毫不迟

延地书面通知出租人。

The Tenant shall give written notice to the Landlord without delay when the Tenant bees aware of any electrical, gas or water installation, wiring or piping on the leased property that proves to be, or may prove to be, a danger.

8.5 承租人应当补偿出租人因更换或修理被承租人或承租人负责的人损坏或破坏的租赁房产中的任何用物而导致

出租人的所有直接费用。出租人必须能够提供有关文件和正式发票以要求付款。正常的损耗不应构成任何该损坏或破坏。

The Tenant shall pensate the Landlord for all direct costs incurred by the Landlord in replacement or repair of any item on the leased property damaged or destroyed by the Tenant or a person for which the Tenant is responsible. The Landlord must be able to provide documentation and official invoice to claim payment. Fair wear and tear shall not constitute any such damage or destruction.

8.6 承租人应采取一切合理的预防措施使租赁房产内部免受暴风雨和其他不利的天气的影响,并应在 遇有该类天

气条件的危险时采取适当措施,比如确保所有的外部门窗都已安全锁住或关闭。

The Tenant shall take all reasonable precautions to protect the interior of the leased property against

damages from storms and other adverse weather conditions and shall, upon threat of such weather condition, take appropriate action, such as, but not restricted to, to ensure that all exterior doors and windows are securely locked or closed.

8.7 承租人应遵守已公布的中国法律和法规,并且不得允许在租赁房产上从事任何非法活动。

The Tenant shall ply with the published Chinese laws and regulations and not permit any unlawful activities on the leased property.

第九条、进入租赁房产的权利

Article9. Right to Enter the Leased Property 9.1 出租人进入租赁房屋内进行正常必要的维修保养工作,应当提前7天书面通知承租人,经承租人同意后方可进

入维修场所;若在紧急情况下无法提前通知承租人,且不紧急进入租赁房内进行抢修或抢救将会产生严重后果的,出租人有权在物业管理人员陪同下,立即进入租赁房屋内从事紧急维修、抢救工作。

Upon written notice the Landlord shall he the right to enter the leased property to perform necessary

maintenance work. In an event of emergency, the Landlord shall he the immediate right to enter the leased property without any prior notice.

9.2 租期届满前一(大写:壹)个月之内,在发出通知后,出租人有权让将来可能的新租户参观该租 赁房产, 但需要

提前通知承租方的居住人。

Within 1 (in words: one) months of the end of the lease term the Landlord shall he the right upon written notice to show the leased property to prospective new tenants.

第十条、转租权

Article10. Subletting Rights

经出租人同意,承租人有权以合理事先书面通知出租人全部或部分将租赁房产转租给其关联企业或将本合同概括转让给其关联企业。

The Landlord agrees that the Tenant is entitled to entirely or partially sublease the Premises or assign this Contract to any of its Affiliate subject to a reasonably advance notice to the Landlord.

第十一条、终止

Article11. Terminate

11.1 租期满11个月之后, 承租人在任何时候都可通过提前 1 (大写:壹)个月书面通知终止本合同。

After 11 months of this leasing term, the Tenant may at any time terminate this Contract under condition of providing one month prior written notice to the Landlord.

11.2 如果租金的支付自到期之日起迟延30(大写:叁拾)天以上并至少超过出租人发出书面通知后的30 (大写:叁拾)

天,出租人应有权终止本合同。

In the event that payment of rent is delayed for more than 30 (in words: thirty) days from the date due and at least 30 (in words: thirty) days after written notice from the Landlord to the Tenant stating the delay is issued the Landlord shall he the right to terminate this Contract.

11.3 如果任何一方资不抵债,或者公司进入清算阶段,另一方应有权终止本合同。

In the event that any of the parties bees bankrupt or in case a pany goes into liquidation the other party shall he the right to terminate this Contract.

第十二条、违约

Article13. Breach of Contract

12.1 由于出租人违约,承租人有权不支付租金,且已支付的当期租金需全额归还。

The Tenant shall he the right to withhold rent payments for Landlords breach of contract

12.2 由于承租人违约,出租人有权不退还承租方已支付的租金。

The landlord shall he the right not to hand back rent payments for tenants breach of contract.

12.3 如果出租人拖延纠正租赁房产上的瑕疵,则承租人有权自行纠正瑕疵并从租金中扣除所支出的费用,条件是承

租人有详细的资料和收据证明其扣除额。

In the event that the Landlord is in delay with correcting defects on the leased property the Tenant shall he the right to correct defects himself and deduct the costs from the rent provided the Tenant supports the deduction with detailed documentation and receipts.

12.4 除了本合同所提到的其他违约,如果本合同的任何一方违反了本合同,受损方应有权就其所受的损失请求赔偿。

Apart from other breaches of contract mentioned in this Contract, if either party to this Contract breaches the contract, the injured party shall he the right to be pensated for direct damages suffered. 12.5 在租赁期内,出租人或承租人中的任何一方均有权以提前一个月通知并支付相当于一个月租金

额的补偿金给对方为条件提前解除本租赁合同。承租人在收到正式发票后30天内支付补偿金给出租人。

During the leasing term, any Party has the right to terminate the contract with one month prior writen notice under condition of paying equal one month rental as pensation to the other side. The tenant will only pay the pensation to the landlord within 30 days after received tax invoice from the landlord.

第十三条、规章制度

Article13. Rules and Regulations

承租人应遵守出租人为管理租赁房产和公共场地而制定的规章制度。出租人必须在该规章生效前 3 (大写:叁)天书面通知承租人。如果该规章制度与本合同有冲突,则以本合同为准。

The Tenant shall follow such reasonable rules and regulations issued by the Landlord for the management of the leased property and mon areas. The Landlord must inform the Tenant in writing of such regulations at least 3 (in words: three) days before the effectiveness of the regulations. In the event such rules and regulations are in contradiction to this Contract, the terms of this Contract shall prevail.

第十四条、争议解决

Article14. Dispute Resolution 由本合同引起的、或由关于本合同的履行引起的任何分歧和争议应由合同双方友好协商解决。如协商不成,依

据《中华人民共和国合同法》规定,双方约定交由承租方所在地人民法院裁决。

Any differences or disputes arising from this Contract or from agreements regarding its performance shall be settled by an amicable effort on the part of both parties to this Contract. If negotiation fails, Both parties agree the dispute shall be settled by application of Chinese law under the jurisdiction of the local court of the tenant.

第十五条、不可抗力

Article16. Force Majeure 15.1 如果因不可抗力而无法履行本合同项下的义务,出租人和承租人都不应承担责任。不可抗力应指不可预见、超

出一方合理控制范围的事件,比如,但不限于:自然力、自然灾害、劳工争议、战争或者类似战争的 情形、骚乱、破坏活动或者严重的火灾。

Neither the Landlord nor the Tenant shall be liable for failure to meet contractual obligations under this Contract due to force majeure. Force majeure shall mean such unforeseeable occurrences beyond the reasonable control of a Party such as, but not restricted to: Acts of God, natural disasters, labor disputes, war or warlike conditions, riot, sabotage and serious fire.

第十六条、其他

Article16. Miscellaneous Clauses 16.1 修订 Amendments

本合同所有的附件、修订、补充和变更应书面做成,并在双方通过协商达成一致后由双方合法授权的代表签署。

它们构成本合同的组成部分,与本合同具有同等效力。

All annexes, amendments, supplements and alterations to this Contract shall be made in writing and signed by the duly authorized representatives of both parties upon the agreement reached between both parties through consultations. They shall form integral parts of this Contract and he the same force as this Contract itself.

16.2 通知 Notice

出租人和承租人特此约定,所有关于对方的权利或义务的交给对方的通知应书面作出。

The Landlord and the Tenant agree hereby that all notices to be delivered to the other Party with regard to either Partys rights or obligations shall be in writing and be sent by messenger, mail, facsimile or courier.

16.3 语言 Language

本合同以英文和中文做成。如有分歧,以中文为准。

This Contract is written in both English and Chinese. If there are any differences between the English version and Chinese version, the Chinese version shall prevail.

16.4 可分割性 Severability 如果本合同的某一条或某一款被认定无效,则本合同的其他条款继续有效,各方应尽最大努力达成一与本

合同的总体意向和目的一致的、且其经济效果相当于无效条款的新条款。

Should an individual provision or clause in this Contract be held invalid or unenforceable, the remaining provisions of this Contract shall continue in force, and the parties shall use their best efforts to arrive at a new provision or clause consistent with the overall intent and objectives of this Contract and which in terms of its economic result corresponds to the invalid provision.

16.5 生效日期 Effective Date

双方签署本合同之日起即为本合同的生效日,本合同一式叁份,出租人执一份,承租人执贰份。

The effective date of this Contract shall be when it has been signed by both parties and registered with the authority as required by law.

第十七条、签字

Article17. Signatures

本合同由各方合法授权的代表签字盖章。

This Contract is signed and sealed by the authorized representatives of the parties hereto.

【附】具有以下情况的房屋不能出租:

(一)未依法取得房屋所有权证的;

(二)司法机关和行政机关依法裁定、决定查封或者以其他形式限制房地产权利的;

(三)共有房屋未取得共有人同意的;

(四)权属有争议的;

(五)属于违法建筑的;

(六)不符合安全标准的;

(七)已抵押,未经抵押权人同意的;

(八)不符合公安、环保、卫生等主管部门有关规定的;

(九)有关法律、法规规定禁止出租的其他情形。
